Every launch has the same pressure: the project is ready, the brochure is printed, buyers are asking — and the MahaRERA registration number has not arrived yet. It is tempting to start advertising “just a teaser”.
We will not run ads for a project before it is registered. Here is why, and what we do instead.
What the law says
Under Section 3 of the Real Estate (Regulation and Development) Act, 2016, a promoter cannot advertise, market, book, sell or offer for sale any plot, apartment or building in a real estate project that needs registration, without first registering the project with the state’s real estate regulatory authority. In Maharashtra, that authority is MahaRERA.
Once a project is registered, MahaRERA also sets rules for how its advertisements look:
- The QR code. MahaRERA Order No. 46/2023, dated 29 May 2023, made it compulsory from 1 August 2023 to show the project’s QR code in its promotions and advertisements, published beside the MahaRERA registration number and the website address. The order covers newspaper and magazine ads, flyers and brochures, site hoardings, project websites and social media ads.
- The penalty. A follow-up order, No. 46A/2023, set a penalty of not less than ₹10,000, which can extend to ₹50,000, for each violation.
- Agents too. Order No. 46B/2023 extended the same obligations to registered real estate agents — which matters if you are a channel partner advertising someone else’s project.
We checked these orders on 10 October 2026. MahaRERA issues new orders from time to time, so always confirm the current position on the MahaRERA website before you publish.
What it means for your ads
Every ad we make for a registered project carries its MahaRERA registration number and QR code — on Instagram, on Facebook, on Google, on the website and on the brochure. If you are a channel partner, we also ask for the developer’s written OK before we advertise their project in your brand.
What we do before the number arrives
A project still waiting for its MahaRERA number is not stuck. In month one we build everything that is not advertising:
- The website and project pages, ready to switch on.
- The Google Business Profile, so your office is on Maps with reviews and photos.
- The social pages, refreshed and consistent.
- A pre-launch page that builds a priority list of interested buyers without advertising the unregistered project.
For one developer we built a launch switch: the promoter’s team can pause or launch the whole site from a phone, behind a PIN — and the site cannot switch to launch mode without a valid MahaRERA number. The rule is built into the website itself.
Only the ads wait for registration. When the number arrives, they go live on a site that is already finished.
The short version
Advertising before registration risks the project’s reputation and a penalty, and it puts the buyer’s trust on the line before you have even met them. Waiting a few weeks costs far less.
